Commission Terms and Conditions
By commissioning my art services, you agree to the following terms. Please read carefully before placing an order.1. How to Place an Order:
- Read the terms carefully before placing your order.
- Send me a message, preferably via Twitter.
- Wait for approval to be added to the waiting list.2. Commission Requirements:
- Age: I do not accept commissions from individuals under the age of 18.
- Commission Selection: I reserve the right to refuse any commission without providing a reason.
- Communication: Only one person will be responsible for communication and feedback. Commissions that require multiple people for review will be refused.
- Queue Cancellation: You can leave the commission queue at any time, but you must inform me if you decide to cancel your order.3. Payment:
-*Payment Methods: Payments are accepted only via PayPal in USD.
- Art/Vtuber Model Commissions:
- 50% deposit after the sketch is approved.
- 50% balance upon completion of the commission.
- Live2D Commissions: Payment will be divided into two parts (deposit and final balance).
- Refunds: Partial refunds are allowed after work has begun, based on the progress. No refunds will be issued once the commission is completed.
- Reservation Fee: A 5% deposit is required to secure your place in the queue.
- Commercial Rights: An additional 50% fee will be charged for commercial use of the art (this does not apply to Vtuber models).4. What I Do Not Accept:
I do not accept commissions for themes such as:
- Furry
- NSFW
- Mecha
- Monsters
- Real people
- Elderly people
- Backgrounds without charactersI do not work with fixed deadlines.5. Changes and Revisions:
- Major changes should only be made during the sketch phase.
- After sketch approval, only small adjustments (such as color changes or details) will be made.
- Major changes after the lineart will not be made.6.Communication and Timeframe:
- Due to mental health reasons, my responses may take time. Please be patient and avoid sending repeated messages.
- If you need to pause the project, please let me know. Otherwise, the process will be paused until I receive your updates.
- Art delivery time can range from 2 weeks to 5 months, depending on the queue and complexity of the commission.
- Vtuber Model commissions can take 1 to 4 months.
- Live2D commissions can take 1 to 5 months, depending on complexity.
- I do not work with fixed or urgent deadlines unless an additional fee is paid.7. Refunds and Cancellations:
- Cancellation: If you cancel after the sketch approval, you will lose your place in the queue, and the reservation fee will not be refunded.
- Refunds: Refunds are possible if no work has begun. Depending on the progress, you may receive a partial refund or no refund at all.
- Chargebacks: Do not initiate a chargeback without contacting me first, as this will result in an immediate block.
- Issues or Discomfort: If anything causes discomfort during the process, I reserve the right to cancel the commission. Depending on the progress, you may receive a partial refund or no refund at all.8. Use of Art:
- Personal Use: The art is for personal use, such as social media profiles and gifts. Commercial use requires an additional fee.
- Restrictions: You have the right to use the art personally, but you cannot resell or edit it without my permission.
- Copyright: I retain the copyright to the art, including the right to use it for promotion and portfolio, unless otherwise agreed.
- Credits: Always credit me when sharing the art (@_KaylaArtist or a link to my social media).
- NFTs: My art cannot be used for NFTs.9. Privacy and Disclosure:
- Non-Disclosure Commissions: I do not accept fully confidential commissions. If you do not opt for privacy, I have the right to post WIPs (works in progress) and share the art on my social media.
- Distribution: I will never distribute your files to third parties without your permission.10. General Rules:
- Client Responsibility: The client is responsible for ensuring that their device can run the commissioned content. No refunds will be issued if the device is incompatible.
- Process Changes: I reserve the right to change the details of the commission process as necessary and will notify you of any significant changes.By requesting a commission, you confirm that you have read, understood, and agree to the terms above.
