Commission Terms and Conditions

By hiring my art services, you agree to the following terms. Please read them carefully before placing an order.

1. How to Place an Order
- Fill out the application form and provide references or a detailed description of your character.
- Approval: I will contact you within a week if you are selected. The slots are not given on a first-come, first-served basis; I will choose based on what I am most interested in working on. I cannot accept all applications TuT.2. Commission Requirements
- Age: I do not accept commissions from individuals under 18 years old.
- Commission Selection: I reserve the right to refuse any commission without explanation.
- Communication: Only one person will be responsible for communication and feedback. Commissions requiring multiple people for review will be declined.
- Queue Cancellation: You can withdraw from the commission queue at any time, but you must notify me if you decide to cancel the order.3. Payment
- Payment Methods: Only via PayPal in USD.
- Vtuber Model Commissions: 50% of the amount as a deposit after sketch approval, and the remaining 50% upon final delivery.
- Live2D Commissions: Payment will be split into two parts: deposit and final balance.
- Refunds: Partial refunds are allowed after work begins, depending on the progress. - No refund after commission delivery.
- Commission Cancellation: If you cancel after the sketch approval, you will lose your spot in the queue, and the reservation fee will not be refunded.4. What I Do Not Accept
- I do not accept commissions for themes such as:
- Furry
- NSFW
- Mecha
- Monsters
- Real people
- I do not work with fixed deadlines unless an additional fee is paid for urgent deadlines.5. Changes and Revisions
- Major Changes: Should only be made during the sketch phase.
- After the Sketch: Once the sketch is approved, only small adjustments will be made (such as color or detail changes).
- Revisions During the Process: You can suggest unlimited revisions during the commission process. After delivery, I offer one free revision for one month. Major changes after that period may incur a fee.6. Communication and Deadline
- Delivery Timeframes: Vtuber model commissions can take 1 to 4 months, depending on the queue and commission complexity, while Live2D commissions can take 1 to 5 months.
- No Fixed Deadlines: I do not work with fixed deadlines unless an additional fee is paid for urgent deadlines. If you have a specific date, such as premiere events or subathons, please inform me in advance.
- Project Pause: If you need to pause the project, let me know. Otherwise, the process will be paused until I receive your updates.7. Refunds and Cancellations
- Cancellation: If you cancel after sketch approval, you will lose your spot in the queue.
- Refunds: Refunds are possible if no work has started. Depending on the progress, you may receive a partial refund or none.
- Chargebacks: Do not initiate a chargeback without contacting me first, as this will result in immediate blocking.
- Issues or Discomfort: If something causes me discomfort during the process, I reserve the right to cancel the commission. Depending on the progress, you may receive a partial refund or none.8. Use of the Art
- Restrictions: You have the right to use the art for personal purposes, but you cannot resell or edit it without my permission.
- Copyright: I retain the copyright of the art, including the right to use it for promotion and portfolio purposes.
- Credits: Always credit me when sharing the art (@_KaylaArtist or link to my social media).
- AI: My art cannot be used for AI or NFTs.9. Privacy and Disclosure
- Non-Disclosure Commissions: Commissions can be kept private upon request. Otherwise, I have the right to share WIPs (works in progress) and disclose the art on my social media.
- Distribution: I will never distribute your files to third parties without your permission.
- Use of Models: I reserve the right to use the model I created for you to create promotional images or videos and post them on my social media after the premiere.10. General Rules
- Client Responsibility: The client is responsible for ensuring their device can run the ordered content. No refunds if the device is incompatible.
- Process Changes: I reserve the right to change the details of the commission process as necessary and will notify you of any significant changes.By requesting a commission, you confirm that you have read, understood, and agree to the above terms.
